Which court handles a DUI on reservation land?
There is no single rule for all reservation DUI arrests. The exact location of the offense, the legal status of the people involved, the specific charge and applicable tribal, federal or state law can affect jurisdiction. A state highway crossing reservation land is not automatically outside Indian country. Check the court name on the citation or charging papers before selecting a lawyer.
Attorney admission matters. An Arizona State Bar license alone does not establish admission to a tribal court. If the charge is in federal court, confirm federal court admission too. Tribal courts may authorize both attorneys and qualified advocates under their rules.
